Terms of Service

These Terms of Service ("Terms") govern your use of the Beeline Agency website and any marketing services provided by Beeline Agency ("we," "us," or "our"). By submitting a form, scheduling a call, or entering into a service agreement with Beeline Agency, you agree to these Terms.
1. SMS / Text Message Program
Program Name: Beeline Agency SMS Notifications
By submitting your phone number and checking the applicable consent checkbox(es) on our form, you expressly consent to receive SMS text messages from Beeline Agency. We offer two separate categories of messages, each requiring its own independent consent:
Service-Based Messages include:
- Follow-up regarding an inquiry or strategy call you requested
- Scheduling, coordination, and appointment or webinar reminders
- Responses to questions you send us
Promotional Messages include:
- Special offers and announcements
- New service or program announcements
- Event and webinar invitations
Message frequency varies. Standard message and data rates may apply depending on your carrier and plan.
Consent is not a condition of purchase. You are not required to consent to SMS messages as a condition of purchasing any product or service from Beeline Agency.
Opt-Out: To stop receiving SMS messages at any time, reply STOP (or OUT) to any message you receive from us. After opting out, you will receive a single confirmation message and will no longer receive SMS messages from us unless you re-subscribe.
Help: For help, reply HELP to any message, or contact us at trey@getbeelineagency.com.
Re-Subscribe: If you previously opted out and wish to receive messages again, reply START to any prior message from us, or submit a new form on our website and check the applicable consent box(es).
Carrier Liability: Wireless carriers are not responsible for delayed or undelivered messages. Beeline Agency is not liable for delays in message delivery caused by carrier networks, device incompatibility, or other factors outside our control.
Compliance: Our SMS messaging program complies with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and all applicable federal and state regulations governing commercial text messaging. We maintain records of consent for all recipients. We do not share, sell, rent, or disclose your SMS opt-in consent data or phone number with any third parties or affiliates for their own marketing purposes.
2. Services
Beeline Agency provides marketing services including but not limited to paid advertising management, landing page creation, offer positioning, funnel strategy, lead follow-up automation, and conversion consulting, primarily for med spas, beauty businesses, and local service brands.
The specific scope of services, deliverables, and fees for each client engagement are outlined in a separate service agreement or proposal. These Terms apply in addition to any such agreement.
3. No Guarantee of Results
Marketing results depend on many factors outside of our control, including but not limited to: ad platform algorithms, market conditions, client offer quality, pricing, client responsiveness, booking processes, and local competition. Beeline Agency does not guarantee specific results, lead volumes, revenue outcomes, or return on ad spend.
We commit to applying our full expertise and best practices to every engagement, but past results from our own business or other clients are not a guarantee of future performance for your business.
4. Client Responsibilities
To receive the full benefit of our services, clients agree to:
- Provide accurate information about their business, offer, and goals
- Grant necessary access to ad accounts, landing pages, CRM, and other platforms in a timely manner
- Review and approve creative assets and strategy within agreed timelines
- Respond to communications within a reasonable timeframe
- Maintain sufficient ad budget as agreed upon in the service agreement
- Handle leads, follow-up, and bookings on their end in a timely manner
Beeline Agency is not responsible for poor results caused by delayed client responses, withheld access, or failure to act on recommendations.
5. Payment Terms
Fees for services are outlined in your service agreement or proposal. Unless otherwise stated:
- Monthly retainer fees are due at the start of each billing period
- Ad spend is separate from agency fees and is paid directly to the ad platform by the client
- Late payments may result in a pause of services until the balance is resolved
- All fees are non-refundable once work has commenced for that billing period
6. Month-to-Month Engagement & Cancellation
Beeline Agency operates on a month-to-month basis with no long-term contracts. Either party may cancel the engagement by providing 30 days' written notice via email to trey@getbeelineagency.com.
During the 30-day notice period, services will continue and any fees due will remain payable. Cancellation does not entitle the client to a refund of fees already paid.
7. Intellectual Property
All strategies, ad copy, creative concepts, landing page designs, and other work product created by Beeline Agency remain the intellectual property of Beeline Agency until full payment has been received. Upon receipt of all outstanding payments, ownership of client-specific deliverables transfers to the client.
Beeline Agency retains the right to reference the existence of the client relationship and general results (without disclosing confidential business data) for portfolio and marketing purposes, unless the client requests otherwise in writing.
8. Confidentiality
Both parties agree to keep confidential any proprietary business information shared during the engagement. Beeline Agency will not share your business strategies, financials, or performance data with third parties without your consent, except as required to deliver services (e.g., ad platforms, CRM tools).
9. Limitation of Liability
To the fullest extent permitted by law, Beeline Agency's total liability for any claim arising out of or related to our services shall not exceed the total fees paid by the client in the 30 days preceding the claim. Beeline Agency is not liable for any indirect, incidental, consequential, or punitive damages, including lost revenue or lost profits.
10. Website Use
By using our website, you agree not to:
- Use the site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the site
- Submit false or misleading information through any form
We reserve the right to refuse service to anyone for any reason at any time.
11. Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the state in which Beeline Agency operates, without regard to conflict of law principles.
